These Terms and Conditions (Terms and Conditions) govern your use of the Ekhsemli website and mobile application, including the website, mobile applications, and smart device applications owned and operated by Ekhsemli for E-Marketing

This website and its services are intended for use by individuals who are eighteen (18) years of age or older. Individuals under this age are prohibited from registering, creating an account, or using the platform, unless otherwise stated in these Terms.

By registering on the website or continuing to use it, you acknowledge the accuracy of your information, including your age. If any false or inaccurate information is provided, Ekhsemli reserves the right to suspend or terminate the account without any obligation or liability

Notwithstanding the foregoing, individuals aged thirteen (13) to under eighteen (18) years are permitted to register, create an account, and use the platform, provided that they acknowledge having reviewed, understood, and agreed to these Terms and Conditions and the Privacy Policy, and commit to complying with them.

Definitions

For the purposes of these Terms, “Ekhsemli,” “we,” “us,” or “our” refers to Ekhsemli for E-Marketing. “You” or “User” refers to any person who visits, uses, or benefits from the platform. “Platform,” “Website,” or “Application” refers to the Ekhsemli website under the domain https://ekhsemli.co  ,the mobile application, and other smart device applications, unless the context requires otherwise.

Cashback Program

The app provides a cashback service that allows users to earn back a portion of their purchase value when shopping through participating stores via the app, subject to the mechanism and terms outlined below.

How Cashback Works

The cashback program allows users to receive a percentage of their purchase amount back when shopping through participating stores via the app, after completing the purchase correctly and meeting all required conditions. Cashback is approved and added to the user’s account after the order is confirmed by the store, and the approval period may take between 14 to 90 days depending on each store’s policy.

Cashback Terms & Conditions

• Users must access the store through the app and activate cashback before completing the purchase.
• The order must be completed within the same browsing session after activating cashback.
• Cashback tracking and appearance may take from a few hours to several days depending on the store.
• Cashback is approved only after the order is confirmed by the store and the return/exchange period has ended.
• Cashback will not be granted for canceled, returned, or incomplete orders.
• Some stores may exclude certain products or categories from cashback eligibility.
• Using unauthorized discount codes or external sources may result in cashback not being tracked or approved.
• Users should ensure that the cart and wishlist are cleared before activating cashback to ensure proper tracking.
• The app reserves the right to modify cashback rates, stop offers, or update the terms at any time without prior notice.
• In cases of misuse or fraudulent activity, the app reserves the right to cancel cashback or suspend the account.

Referral Code & Rewards Program

The app provides a referral program that allows users to share their personal referral code with friends to earn rewards within the app. When a new user successfully registers using the referral code, the code owner receives a reward added to their wallet in the app, and the new user also receives a welcome reward added to their wallet.

Users may use the balance earned from cashback or referral rewards to redeem digital vouchers or electronic gift cards through the Rewards section, based on the available values and offers within the app.

Referral Program Terms & Conditions

The referral code must be entered during account registration and cannot be added after the registration process is completed.
Rewards are added only after successful registration and fulfillment of the required conditions.
The app reserves the right to review, suspend, or cancel any rewards or balances resulting from activities suspected of violating the app’s policies, including fraud, misuse, manipulation attempts, or fake accounts. The app may also take appropriate actions, including temporary or permanent suspension or closure of the account at its sole discretion.
Reward values may vary or change according to the app’s policies and available promotions.
Digital vouchers and gift cards are subject to availability, and their values or types may change from time to time.
All digital vouchers and gift cards are subject to a specific expiration date, and users are responsible for using them before expiry.
Once a balance has been redeemed for a digital voucher or gift card, the redemption cannot be canceled and the balance cannot be refunded.
Users are responsible for verifying redemption details before confirming the request.
Wallet balances cannot be withdrawn or transferred outside the options available within the app.
The app reserves the right to modify, suspend, or terminate the referral and rewards program, or update its terms at any time without prior notice.

Intellectual Property Rights

All intellectual property rights related to the platform or its content, including texts, designs, logos, software, and databases, are owned by us or licensed to us and are protected under the applicable laws of the Kingdom of Saudi Arabia. Your use of the platform does not grant you any right or license to use any intellectual property rights except for personal, non-commercial use as permitted under these Terms.

Usage Restrictions

You agree not to use the platform in any way that involves copying, selling, sublicensing, or commercially exploiting any part of the platform’s content. You also agree not to use the platform in a manner that may harm, disrupt, or affect its performance or availability, violate the laws and regulations applicable in the Kingdom of Saudi Arabia, attempt unauthorized access to the platform’s systems or servers, or collect, extract, or mine data or content without prior authorization. We reserve the right to restrict or block your access to any part of the platform at any time at our sole discretion.

User-Provided Content

If the platform allows you to upload or publish content, you grant us a non-exclusive, irrevocable, worldwide, royalty-free license to use, copy, display, modify, and publish such content to the extent necessary to operate the platform and improve its services. You represent and warrant that any content you publish is owned by you or that you have the legal right to use it and that it does not infringe the rights of any third party. We reserve the right to remove any violating content without prior notice.

The platform and its content are provided “as is” without any express or implied warranties of any kind. We do not guarantee that the platform will be free from errors or interruptions, and no content available through the platform shall be considered binding advice or consultation.

No Responsibility for Merchants, Products, and Services

You acknowledge and agree that the Ekhsemli platform does not sell, provide, or ship any products or services, does not represent any merchant or service provider, and is not a party to any contractual relationship between the user and any third party. Full responsibility for products, services, prices, shipping, warranties, return policies, or any other obligations lies solely with the merchant or service provider, and the platform bears no legal or financial responsibility in this regard.

No Guarantee of Accuracy or Continuity of Offers and Coupons

Promotional offers, prices, discounts, and coupons displayed on the platform are provided by third parties and may be changed, suspended, or expired at any time without prior notice. Ekhsemli does not guarantee the accuracy, validity, or continuity of any offer, price, or coupon, and users are responsible for verifying offer details before completing any purchase.

Indemnification

By using the platform, you agree to indemnify and release us from any claims, losses, damages, or expenses, including legal fees, arising from your use of the platform or violation of these Terms.

Accuracy of Information

You acknowledge that all information and data provided when creating your account are accurate, complete, and up to date, and you bear full responsibility for any incorrect information. We reserve the right to suspend or terminate your account if otherwise proven.

Severability
